Photoshop CS4 jsxbin files

It seems that while jsxbin scripts that have been created in CS4 work in CS4 but will NOT work in CS3.
Photoshop CS3 jsxbin scripts will work in CS3 and CS4

yes I've noticed that too. Funny.

The error shows as:

Error 25: Expected: ;.
Line 1

then a dump of the binary.

That error is normally caused by having:
#target photoshop

Remove this line and you should be fine.
